Florida Cannabis Laws 2026: Medical Only, and What Happens Without a Card

Florida has a big medical marijuana program, but recreational cannabis is still a crime. Here's what patients can buy and what everyone else risks.

TL;DR

Recreational cannabis is illegal in Florida: up to 20 grams is a misdemeanor, and more is a felony. Medical cannabis is legal for registered patients, who can buy up to 2.5 ounces of smokable flower every 35 days. No home growing. The 2024 legalization amendment fell short of the 60% needed, and a 2026 effort did not qualify.

Florida voters approved medical cannabis with Amendment 2 in 2016. A 2024 recreational legalization amendment (Amendment 3) won about 56% of the vote but fell short of the 60% Florida requires for constitutional amendments. A follow-up effort for 2026 did not qualify for the ballot. So Florida remains medical-only.

Is weed legal in Florida?

Not for recreational use. You need to be a registered medical patient with a state ID card to buy or possess cannabis legally.

Penalties without a medical card

  • Up to 20 grams: a first-degree misdemeanor, with up to 1 year in jail and a $1,000 fine
  • More than 20 grams: a third-degree felony, with up to 5 years in prison and a $5,000 fine
  • Concentrates and vapes: can be charged more harshly regardless of weight

Some counties and cities, including Miami-Dade, let officers issue a civil citation for small amounts instead of arresting, but that's local discretion, not a change in state law.

Medical cannabis in Florida

To qualify, you need certification from a qualified physician for a condition such as cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn's disease, Parkinson's, MS, chronic nonmalignant pain, a terminal condition, or a comparable condition. Then you apply to the Office of Medical Marijuana Use (OMMU) for an ID card.

Limit Medical patients
Smokable flower Up to 2.5 ounces every 35 days, and no more than 4 ounces on hand
Edibles Up to 10 mg of THC per serving
Home grow Not allowed

Driving and work

Driving while impaired is illegal, including for patients. Florida employers can keep drug-free workplace policies and drug testing, and medical use isn't protected on the job.

Hemp products in Florida

Hemp-derived products like CBD and delta-8 have been sold legally under Florida's hemp rules, but the federal hemp changes coming in late 2026 (below) will take many intoxicating hemp products off the shelves.

Is anything changing in 2026?

The 2026 recreational legalization petition was blocked after the state determined it didn't have enough valid signatures, and a court denied the campaign's challenge. Nothing on cannabis legalization is on Florida's November 2026 ballot. Medical rules are unchanged.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
