Massachusetts Cannabis Laws 2026: New Limits, and Question 8 on the Ballot

Massachusetts doubled its possession limits in April 2026, and in November voters decide whether to end recreational sales. Here's what's legal right now and what's at stake.

TL;DR

Adults 21+ can carry and buy up to 2 ounces of flower, 10 grams of THC in concentrates and 1,000 mg of THC in edibles, and keep up to 10 ounces at home. Home grow is 6 plants per adult, 12 per household. On November 3, 2026, Question 8 asks voters whether to end adult-use sales starting in 2028 and end adult home grow.

Massachusetts voters approved medical cannabis in 2012 and recreational cannabis with Question 4 in 2016. The first adult-use stores on the East Coast opened here in November 2018. In April 2026, Governor Healey signed H. 5350, which doubled possession and purchase limits. The Cannabis Control Commission (CCC) regulates the market.

Is weed legal in Massachusetts?

Yes, for adults 21 and older, at least for now (see Question 8 below). Bring a valid ID showing you're 21+. Visitors can buy too.

How much can you carry and keep?

Limit Adults 21+
On you, and per purchase Up to 2 ounces of flower, 10 grams of THC in concentrates, or 1,000 mg of THC in edibles
At home Up to 10 ounces, with anything over 2 ounces kept locked up

These are the new 2026 limits, up from 1 ounce, 5 grams and 500 mg.

Where can you use it?

Private property, with the owner's permission. Using cannabis in public is a civil infraction with a fine. The 2026 law creates new licenses for on-site and event consumption, which may open legal places to use outside the home once regulators set them up. Landlords can ban smoking and growing.

Can you grow cannabis at home?

Yes. Adults 21+ can grow up to 6 plants, with a limit of 12 plants per household. Plants must be in an enclosed, locked area out of public view.

Medical cannabis in Massachusetts

Patients with a qualifying condition can register with the CCC. Medical purchases are exempt from cannabis excise and sales taxes, and patients can get a hardship cultivation registration to grow more.

Taxes on cannabis in Massachusetts

Adult-use purchases carry a 10.75% state excise tax, the 6.25% state sales tax, and up to a 3% local tax, for a total of up to 20%. Medical purchases are exempt.

Driving and work

Driving impaired is illegal, and open containers of cannabis in a car are banned. Employers can keep drug-free workplace policies.

Is anything changing in 2026?

Yes, the biggest vote on cannabis anywhere this year. On November 3, 2026, voters decide Question 8, a citizen initiative to repeal adult-use cannabis sales.

  • A yes vote would make recreational sales illegal starting January 1, 2028, and end adult home growing. Adults could still possess up to 1 ounce, and medical cannabis would continue.
  • A no vote keeps the current system, including the new 2026 limits.

Governor Healey opposes Question 8, and a UMass Amherst poll found 55% of voters opposed it.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
