New Jersey Cannabis Laws 2026: What's Legal, and Why You Still Can't Grow

New Jersey voters legalized recreational cannabis in 2020, and lounges started opening in 2025. Here's what you can buy and carry, and the home-grow fight.

TL;DR

Adults 21+ can possess up to 6 ounces without penalty and buy up to 1 ounce per transaction. Home growing is still illegal, even for patients, though 2026 bills would change that. Sales carry the 6.625% sales tax, a small social equity fee, and up to 2% local tax. Consumption lounges started opening in 2025.

New Jersey voters approved recreational cannabis with Public Question 1 in November 2020, and lawmakers passed the CREAMM Act in 2021. Adult-use sales began on April 21, 2022. Medical cannabis has been legal since 2010. The Cannabis Regulatory Commission (CRC) regulates the market.

Is weed legal in New Jersey?

Yes, for adults 21 and older. Residents and visitors 21+ can buy with a valid ID.

How much can you buy and carry?

Limit Adults 21+
Per purchase Up to 1 ounce of flower, or an equivalent mix of products
Possession Up to 6 ounces without any criminal or civil penalty

Adults can also give up to 1 ounce to another adult for free.

Where can you use it?

Private property, with the owner's permission. Using cannabis in public is illegal, and towns can set fines. The first licensed consumption lounges opened in August 2025, and more are expected through 2026. Landlords can ban smoking.

Can you grow cannabis at home?

No. Growing cannabis at home is still illegal in New Jersey, even for medical patients, which makes it an outlier among legal states. A 2026 bill (S2564) would allow 6 plants for adults (10 for patients), and companion bills would allow patients to grow, but none had passed at our last review.

Medical cannabis in New Jersey

Patients with a qualifying condition can register with the CRC's medical program. Medical purchases are exempt from sales tax, and patients get priority access.

Taxes on cannabis in New Jersey

Adult-use purchases carry New Jersey's 6.625% sales tax, a small social equity excise fee, and up to 2% local tax in towns that add one. Medical purchases are exempt from sales tax.

Driving and work

Driving impaired is illegal. New Jersey law bars employers from punishing most workers just for using cannabis off the clock, but they can ban use and impairment at work.

Old marijuana convictions

New Jersey's 2021 laws led to the automatic expungement of hundreds of thousands of low-level cannabis cases.

Is anything changing in 2026?

Home-grow bills are the main thing to watch. Consumption lounges are also expanding. Possession and purchase limits haven't changed.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
