New York legalized recreational cannabis in 2021, and adults can smoke in many of the same places tobacco is allowed. Here's what you can carry, keep and grow.

TL;DR
Adults 21+ can carry up to 3 ounces of flower and 24 grams of concentrate, and keep up to 5 pounds at home. Home grow is 6 plants per adult (3 mature), 12 per household. Smoking is allowed in many places where tobacco smoking is. Sales carry a 13% retail tax (9% state, 4% local). Most workers are protected for off-duty use.
New York lawmakers legalized recreational cannabis with the Marijuana Regulation and Taxation Act (MRTA), signed on March 31, 2021. The first licensed store opened in Manhattan in December 2022. Medical cannabis has been legal since 2014. The Office of Cannabis Management (OCM) regulates both markets.
Is weed legal in New York?
Yes, for adults 21 and older. Bring a valid ID showing you're 21+. Visitors can buy too. Buy from licensed stores only: OCM posts a verification QR code in every licensed shop, and the state has been shutting down unlicensed ones.
How much can you carry and keep?
| Limit | Adults 21+ |
|---|---|
| On you | Up to 3 ounces of flower and 24 grams of concentrate |
| At home | Up to 5 pounds, kept secure from anyone under 21 |
Carrying more than 3 ounces brings a fine, and larger amounts are misdemeanors.
Where can you use it?
New York is unusually open here: adults can smoke or vape cannabis in many places where smoking tobacco is allowed, which includes some sidewalks. It's banned in cars (even parked), in workplaces, in restaurants and bars, on school grounds, in most parks and beaches, and anywhere else tobacco is banned. Towns can ban public use, and landlords can ban smoking.
Can you grow cannabis at home?
Yes. Adults 21+ can grow up to 6 plants, with no more than 3 mature at a time, and a limit of 12 plants per household. Plants must be out of public view and secured from people under 21. Medical patients and caregivers can grow at home starting at age 18.
Medical cannabis in New York
Patients with a certification from a registered practitioner can join the medical program. Practitioners can certify any condition they think cannabis could help. Medical purchases carry a much lower tax.
Taxes on cannabis in New York
Adult-use purchases carry a 13% retail tax: 9% state and 4% local. A separate 9% wholesale tax is built into shelf prices. Medical purchases are taxed at a lower rate.
Driving, work and housing
- Driving: Driving impaired is illegal, and using cannabis in any vehicle is banned.
- Work: New York protects most workers from being punished for legal off-duty cannabis use. Employers can still act if a worker is impaired on the job, and some jobs are exempt.
- Housing: Landlords can ban smoking and growing.
Old marijuana convictions
The MRTA automatically expunged past convictions for conduct that's now legal, and people with other cannabis convictions can ask a court to resentence or seal them.
Is anything changing in 2026?
For medical patients, the age to grow at home dropped to 18. The crackdown on unlicensed shops continues. Adult-use limits haven't changed.
Federal law in 2026
Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.
Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
