Oregon Cannabis Laws 2026: What's Legal for Adults and Patients
Oregon voters legalized recreational cannabis in 2014, and Portland has more dispensaries than almost any city in the country. Here's what you can carry, keep and grow.

TL;DR
Adults 21+ can carry up to 2 ounces of flower in public and keep up to 8 ounces at home. Home grow is 4 plants per household. Public use is illegal. Sales carry a 17% state tax plus up to 3% local tax, and medical purchases are tax-free. A 2026 law adds hospice and comfort care as a medical qualifying condition in 2027.
Oregon voters approved medical cannabis in 1998 and recreational cannabis with Measure 91 in 2014. Adult-use sales started in October 2015. The Oregon Liquor and Cannabis Commission (OLCC) regulates the adult-use market, and the Oregon Health Authority runs the medical program.
Is weed legal in Oregon?
Yes, for adults 21 and older. Bring a valid ID showing you're 21+. Visitors can buy too.
How much can you carry and keep?
| Limit | Adults 21+ |
|---|---|
| In public | Up to 2 ounces of flower and 1 ounce of concentrate |
| At home | Up to 8 ounces of flower |
Having more than 2 ounces in public, up to 4 ounces, is a violation with a fine. Larger amounts are crimes.
Where can you use it?
Private property, with the owner's permission. Public use is illegal, and so is using it in a car. Oregon has no licensed consumption lounges yet. Federal land, including national forests and Crater Lake, is off-limits. Landlords can ban smoking.
Can you grow cannabis at home?
Yes. A household can grow up to 4 plants, no matter how many adults live there. Plants must be out of public view. Registered medical patients can grow more.
Medical cannabis in Oregon
Patients with a qualifying condition can register with the Oregon Medical Marijuana Program. Medical purchases are tax-free, and patients and their growers can have higher limits.
Taxes on cannabis in Oregon
Adult-use purchases carry a 17% state tax, plus up to 3% local tax in cities and counties whose voters approved one. Medical purchases are exempt.
Driving and work
Driving impaired is illegal. Employers can keep drug-free workplace policies, and Oregon doesn't protect off-duty use.
Old marijuana convictions
People with past cannabis convictions for conduct that's now legal can ask a court to set them aside, and a 2021 law made this easier for many low-level cases.
Is anything changing in 2026?
One medical change. HB 4142 ("Ryan's Law"), passed in 2026, adds the need for hospice, palliative or comfort care to the list of qualifying conditions, starting January 1, 2027. A bill to tax intoxicating hemp products and make other changes failed. Possession and home-grow limits haven't changed.
Federal law in 2026
Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.
Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
