West Virginia has a medical cannabis program, but recreational cannabis is still illegal, and any amount can bring jail time. Here's how it works.

TL;DR
Recreational cannabis is illegal in West Virginia: possessing any amount is a misdemeanor with 90 days to 6 months in jail and a fine of up to $1,000, though first offenses under 15 grams can end in probation. Registered patients can buy up to a 30-day supply. Smoking is banned and there's no home grow. 2026 bills to add edibles and reduce penalties didn't pass.
West Virginia lawmakers legalized medical cannabis in 2017, and dispensaries opened in late 2021. Recreational cannabis is illegal. The Office of Medical Cannabis runs the program.
Is weed legal in West Virginia?
Only for registered medical patients. Everyone else can still be charged.
Penalties without a medical card
- Any amount: a misdemeanor, with 90 days to 6 months in jail and a fine of up to $1,000
- First offense, less than 15 grams: the court can give probation, and finishing it means no conviction on your record
- Selling or growing: a felony
Morgantown lets city police write a small fine for 15 grams or less, but state law still applies.
Medical cannabis in West Virginia
Patients need certification from a registered physician for a serious medical condition, such as cancer, chronic pain, PTSD, epilepsy or a terminal illness, then get a card from the Office of Medical Cannabis.
| Rule | Medical patients |
|---|---|
| Supply | Up to a 30-day supply, and you can't refill until you're down to 7 days' worth |
| Forms | Pills, oils, tinctures, topicals, liquids and vape products. Smoking is banned |
| Home grow | Not allowed |
Driving and work
Driving while impaired is illegal, including for patients. Employers can keep drug-free workplace policies.
Is anything changing in 2026?
No. A bill to allow edibles (HB 5260) passed the House but died in the Senate, and bills to make small possession a civil fine and to let patients grow at home didn't pass. West Virginia doesn't have a citizen ballot initiative process.
Federal law in 2026
Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.
Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
