There's no medical program. Since July 2024, delta-8, THCA flower and other intoxicating hemp products are treated as illegal THC.

Hemp, delta-8 and THCA in Wyoming
Under Senate File 32, in effect since July 1, 2024, Wyoming counts delta-8, delta-10, HHC, THC-O, THCP and other psychoactive forms of THC as THC, and measures hemp by total THC. That makes most THCA flower and intoxicating hemp products illegal. A federal appeals court upheld the law in 2025.
Crossing the border
Buying legally in Colorado or Montana doesn't protect you in Wyoming. Bringing cannabis across the state line is illegal, and highway patrols watch the I-25 and I-80 corridors.
Driving and work
Driving under the influence of cannabis is a DUI. Employers can test for and ban cannabis use.
Is anything changing in 2026?
No legalization or medical cannabis bill passed in 2026. A bill to give first-time possession offenders a path to probation and dismissal was introduced, but we couldn't confirm that it passed.
Federal law in 2026
Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.
Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
