Illinois Cannabis Laws 2026: New, Higher Possession Limits for Adults

Illinois was the first state to legalize recreational cannabis through its legislature, and a 2026 law doubled how much residents can carry. Here's what's legal now.

TL;DR

Adults 21+ who live in Illinois can now possess 60 grams of flower, 10 grams of concentrate and 1,000 mg of THC in products (half that for visitors), thanks to SB 3222, signed June 12, 2026. Home grow is for medical patients only (5 plants). Public use is illegal. Taxes are tiered by potency, plus state and local sales taxes.

Illinois legalized medical cannabis in 2013 and became the first state to legalize recreational cannabis through its legislature with the Cannabis Regulation and Tax Act, which took effect on January 1, 2020. In June 2026, Governor Pritzker signed SB 3222 (Public Act 104-0463), which doubled possession limits and updated many other rules.

Is weed legal in Illinois?

Yes, for adults 21 and older. Bring a valid ID showing you're 21+. Visitors can buy too, with lower limits.

How much can you carry?

Limit Illinois residents 21+ Visitors 21+
Flower Up to 60 grams Up to 30 grams
Concentrate Up to 10 grams Up to 5 grams
THC in infused products Up to 1,000 mg Up to 500 mg

These are the new SB 3222 limits, double what residents could carry before.

Where can you use it?

Private property, with the owner's permission. Public use is illegal, including in parks, on sidewalks, in cars and anywhere smoking tobacco is banned. Some towns allow licensed consumption lounges, and landlords can ban smoking.

In a car, cannabis has to be in a sealed, odor-proof, child-resistant container out of the driver's reach.

Can you grow cannabis at home?

Only if you're a registered medical patient. Patients can grow up to 5 plants per household, in an enclosed, locked space out of public view. Growing without a medical card is a crime.

Medical cannabis in Illinois

Patients with a qualifying condition can register with the state's medical cannabis program. Patients can buy up to 2.5 ounces every 14 days, pay a much lower tax, and are the only people allowed to grow at home.

Taxes on cannabis in Illinois

Illinois taxes adult-use cannabis by potency:

  • 10% on flower with 35% THC or less
  • 20% on cannabis-infused products like edibles
  • 25% on anything over 35% THC, like most concentrates

On top of that come the 6.25% state sales tax and local taxes, plus a 7% wholesale tax built into prices. Medical cannabis pays only a 1% tax.

Driving, work and housing

  • Driving: Driving impaired is illegal, and using cannabis in a car is banned for drivers and passengers.
  • Work: Employers can keep drug-free workplace policies and discipline employees who are impaired on the job.
  • Housing: Landlords can ban smoking and growing.

Old marijuana convictions

Illinois's 2020 law led to hundreds of thousands of low-level cannabis records being expunged and more than 11,000 convictions pardoned. SB 3222 expands the process further.

Is anything changing in 2026?

Yes. SB 3222 is the big one: higher possession limits for residents, new rules for intoxicating hemp products, and expanded expungement. Check the Illinois Department of Financial and Professional Regulation for details as new rules roll out.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
