Indiana has no recreational or medical cannabis program, even though neighbors Illinois, Michigan and Ohio have legalized. Here's what you need to know.

TL;DR
Cannabis is illegal in Indiana for all uses. Possessing less than 30 grams is a Class B misdemeanor (up to 180 days in jail and a $1,000 fine); larger amounts or prior convictions bring tougher charges. CBD with no more than 0.3% THC is legal. No legalization bill passed in 2026.
Indiana is surrounded by states that allow cannabis: Illinois, Michigan and Ohio have legalized recreational use, and Kentucky has a medical program. But Indiana itself has no legal cannabis program. The only exception is low-THC CBD.
Is weed legal in Indiana?
No. Possessing, growing or selling cannabis is a crime, and Indiana doesn't recognize medical cards from other states.
Penalties
- Less than 30 grams: a Class B misdemeanor, with up to 180 days in jail and a $1,000 fine
- Less than 30 grams with a prior drug conviction: a Class A misdemeanor, with up to 1 year in jail
- 30 grams or more: a Class A misdemeanor, and a felony with a prior drug conviction
- Growing: charged like possession, based on weight
Some county prosecutors, including in Marion County (Indianapolis), have chosen not to prosecute small possession cases, but that's local policy and doesn't change state law.
CBD and hemp in Indiana
CBD products with no more than 0.3% THC are legal in Indiana, as long as they meet the state's labeling rules. The federal hemp changes coming in late 2026 (below) will take many intoxicating hemp products off the shelves nationwide.
Crossing the border
Buying legally in Illinois, Michigan or Ohio doesn't protect you in Indiana. Bringing cannabis back across the state line is illegal.
Driving and work
Driving with THC or its metabolites in your system can lead to an OWI charge. Employers can test for and ban cannabis use.
Is anything changing in 2026?
No. Bills to legalize or decriminalize cannabis were filed again but didn't pass. Indiana doesn't have a citizen ballot initiative process, so any change has to come from the legislature.
Federal law in 2026
Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.
Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
