Kentucky Cannabis Laws 2026: The Medical Program Is Open, Recreational Isn't

Kentucky's medical cannabis program launched in 2025 and dispensaries have been opening across the state. Here's how it works and what's still illegal.

TL;DR

Recreational cannabis is illegal in Kentucky: up to 8 ounces is a misdemeanor (up to 45 days and a $250 fine). Registered medical patients can buy from licensed dispensaries and keep a 30-day supply at home and a 10-day supply on them. Flower can be vaped but not smoked. No home grow.

Kentucky lawmakers legalized medical cannabis with SB 47 in 2023, and the program started on January 1, 2025. Dispensaries have been opening steadily since, and more than 11,000 patients had cards by mid-2026. Recreational cannabis is still illegal. The Office of Medical Cannabis runs the program.

Is weed legal in Kentucky?

Only for registered medical patients. Everyone else can still be charged.

Penalties without a medical card

  • Less than 8 ounces: a misdemeanor, with up to 45 days in jail and a $250 fine
  • 8 ounces or more: treated as possession with intent to sell, a felony
  • Growing fewer than 5 plants: a misdemeanor for a first offense, with up to 1 year in jail; 5 or more plants is a felony

Medical cannabis in Kentucky

Patients need certification from a registered practitioner for a qualifying condition, such as cancer, chronic or severe pain, epilepsy, MS, chronic nausea or PTSD, then apply for a card from the Office of Medical Cannabis.

Limit Medical patients
At home Up to a 30-day supply (112 grams of flower, 28 grams of concentrate, or 3,900 mg of THC in products)
On you Up to a 10-day supply (37.5 grams of flower, 9.5 grams of concentrate, or 1,300 mg of THC in products)
Forms Flower for vaping only (smoking is banned), edibles up to 10 mg THC per serving, oils, tinctures and concentrates up to 70% THC
Home grow Not allowed

You can carry more than a 10-day supply straight home from the dispensary if it's in its sealed package.

Governor's executive order

An executive order from Governor Beshear still protects people with certain medical conditions who buy small amounts of cannabis legally in another state and bring it home, as long as they keep the receipt and a doctor's certification. It was meant to bridge the gap until dispensaries opened statewide.

Driving and work

Driving while impaired is illegal, including for patients. Employers can keep drug-free workplace policies.

Is anything changing in 2026?

More dispensaries are opening. Bills to allow patients to smoke at home and grow a few plants didn't get hearings in 2026. Kentucky doesn't have a citizen ballot initiative process.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
