Louisiana Cannabis Laws 2026: Medical Flower, Decriminalization and Penalties

Louisiana has a medical program that includes smokable flower, and small amounts are decriminalized for everyone. Recreational cannabis is still illegal.

TL;DR

Recreational cannabis is illegal in Louisiana, but 14 grams or less is decriminalized to a fine of up to $100 with no jail. Medical patients with a doctor's recommendation can buy up to 2.5 ounces of flower every 14 days from licensed pharmacies. No home grow. Adult-use bills stalled in 2026.

Louisiana's medical program dates to 2015, and it's grown a lot since: doctors can now recommend cannabis for any condition they consider debilitating, and smokable flower has been sold since 2022. In 2021, the state decriminalized small amounts. Recreational cannabis is still illegal. The Louisiana Department of Health regulates medical cannabis.

Is weed legal in Louisiana?

Only for medical patients. For everyone else, small amounts are decriminalized but not legal.

Penalties without a medical recommendation

  • 14 grams or less: a fine of up to $100, with no arrest and no jail
  • More than 14 grams, first offense: up to 6 months in jail and a $500 fine
  • Repeat offenses: penalties climb, up to 8 years in prison for a fourth offense
  • Near schools and other drug-free zones: enhanced penalties

Medical cannabis in Louisiana

Louisiana doesn't use a state ID card. Instead, a licensed physician (or certain other practitioners) sends a recommendation to a licensed marijuana pharmacy for any condition they believe is debilitating.

Driving and work

Driving while impaired is illegal, including for patients. Employers can keep drug-free workplace policies.

Hemp products in Louisiana

Louisiana has tightened rules on intoxicating hemp products in recent years, and the federal hemp changes coming in late 2026 (below) will take many more off the shelves.

Is anything changing in 2026?

A bill to create an adult-use pilot program was pulled by its sponsor. The main cannabis bill that passed lets patients and caregivers possess and use medical cannabis in healthcare facilities. Louisiana doesn't have a citizen ballot initiative process for laws.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
