Maine Cannabis Laws 2026: What's Legal for Adults and Patients
Maine voters legalized recreational cannabis in 2016, and the state has generous home-grow rules. Here's what you can carry, grow, and what changed with taxes in 2026.

TL;DR
Adults 21+ can possess up to 2.5 ounces (including up to 10 grams of concentrate) and grow 6 mature plants, 12 immature plants and unlimited seedlings. Public use is illegal. The adult-use sales tax rose to 14% on January 1, 2026. A repeal campaign missed the deadline for the 2026 ballot.
Maine voters approved medical cannabis in 1999 and recreational cannabis with Question 1 in 2016. Licensed adult-use stores opened in October 2020. The Office of Cannabis Policy (OCP) regulates both markets.
Is weed legal in Maine?
Yes, for adults 21 and older. Bring a valid ID showing you're 21+. Visitors can buy too. Many towns have opted out of allowing stores, so check before you go.
How much can you carry?
| Limit | Adults 21+ |
|---|---|
| Possession and purchase | Up to 2.5 ounces of cannabis, or a combination of cannabis and concentrate |
| Concentrate | No more than 10 grams within that 2.5 ounces |
Adults can also give up to 2.5 ounces to another adult for free.
Where can you use it?
Private property, with the owner's permission. Public use is illegal and brings a civil fine, and that includes using in a car. Landlords can ban smoking.
Can you grow cannabis at home?
Yes, and Maine's limits are some of the most generous. Adults 21+ can grow up to 6 mature plants, 12 immature plants and an unlimited number of seedlings. Each plant has to be tagged with your name and ID number, and plants have to be kept out of public view and secured.
Medical cannabis in Maine
Maine's medical program lets any medical provider certify a patient for any condition they think cannabis could help. Patients and caregivers buy from medical dispensaries and caregiver shops, and pay a lower tax than adult-use customers.
Taxes on cannabis in Maine
As of January 1, 2026, adult-use purchases carry a 14% sales tax, up from 10%. At the same time, the excise tax growers pay dropped (from $335 to $223 per pound of flower), which could help hold down shelf prices. Medical cannabis is taxed at a lower rate.
Driving and work
Driving impaired is illegal. Maine law says employers can't refuse to hire or punish people just for using cannabis off the clock, but they can ban use and impairment at work.
Is anything changing in 2026?
The tax change above is the big one. A campaign to repeal adult-use sales and home growing missed the deadline to make the November 2026 ballot, so it's not on this year's ballot. The group is aiming for 2027 instead.
Federal law in 2026
Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.
Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
