Texas Cannabis Laws 2026: Medical Program Expands, Hemp THC Gets Banned

Texas still bans recreational cannabis, but its limited medical program grew a lot, and in July 2026 most hemp THC products became illegal. Here's what you need to know.

TL;DR

Recreational cannabis is illegal in Texas: 2 ounces or less is a Class B misdemeanor (up to 180 days and a $2,000 fine), and concentrates and vapes are treated as felonies. The Compassionate Use Program now covers chronic pain and more conditions. As of July 31, 2026, delta-8, THCA and most hemp THC products are illegal.

Texas has a limited medical program, the Texas Compassionate Use Program (TCUP), which a 2025 law (HB 46) expanded. Recreational cannabis is illegal. In 2026, the state also made most intoxicating hemp products illegal.

Is weed legal in Texas?

Not for recreational use. Only registered TCUP patients can legally buy low-THC cannabis products.

Penalties

  • 2 ounces or less: a Class B misdemeanor, with up to 180 days in jail and a $2,000 fine
  • More than 2 ounces, up to 4 ounces: a Class A misdemeanor, with up to 1 year in jail
  • More than 4 ounces: a felony
  • THC concentrates, vapes and edibles: charged under a harsher penalty group, so even a small amount can be a felony

Some Texas cities have passed local ordinances to deprioritize small possession cases, but the state has challenged them, and state law still applies.

Medical cannabis: the Compassionate Use Program

TCUP patients get prescriptions from registered doctors and buy from licensed dispensing organizations. Under HB 46 (signed June 2025):

  • More conditions qualify, including chronic pain lasting more than 90 days, Crohn's disease, traumatic brain injury, and terminal illness or hospice care
  • New THC limits of up to 10 mg per dose and 1 gram of THC per package, replacing the old 1% cap
  • More dispensing organizations, from 3 to 15, with satellite pickup locations

Smokable flower is still not allowed, and there's no home grow.

The hemp THC ban

After a May 2026 Texas Supreme Court decision let the state health department reclassify hemp-derived THC, Texas began enforcing a ban on delta-8, delta-10, THCA (including THCA flower), THCP and similar products on July 31, 2026. These are now treated as controlled substances, so possessing them can bring felony charges. Low-dose hemp delta-9 products remain legal for now, and lawsuits over the ban are ongoing.

Driving and work

Driving while impaired is illegal, including for patients. Employers can test for and ban cannabis use.

Is anything changing in 2026?

Yes: the TCUP expansion is rolling out and the hemp ban took effect. Texas doesn't have a statewide citizen ballot initiative process, so recreational legalization would have to come from the legislature.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.

Where to shop

Only registered patients can buy from Texas's licensed TCUP dispensing organizations. Browse smoke and vape shops in Texas in our directory. Most listings under Texas dispensaries are hemp and CBD shops, which must follow the new rules.
