Utah Cannabis Laws 2026: The Medical Program and What's Still Illegal

Utah has a tightly regulated medical cannabis program run through licensed pharmacies. Recreational cannabis is illegal. Here's how it works.

TL;DR

Recreational cannabis is illegal in Utah: less than 1 ounce is a misdemeanor with up to 6 months in jail and a $1,000 fine. Medical cardholders can buy up to 113 grams of flower or 20 grams of THC in other products every 28 days from licensed pharmacies. Flower must be vaped, not smoked, and there's no home grow.

Utah voters approved medical cannabis with Proposition 2 in 2018, and lawmakers replaced it weeks later with the Utah Medical Cannabis Act, a compromise that's been amended many times since. Patients buy from licensed medical cannabis pharmacies. Recreational cannabis is illegal. The Department of Health and Human Services runs the program.

Patients need a recommendation from a registered medical provider for a qualifying condition, then get a card from the state.

Limit Medical cardholders
Every 28 days Up to 113 grams (about 4 ounces) of flower, or up to 20 grams of THC in other forms
Forms Flower for vaping only (smoking is banned), plus capsules, tinctures, gummies, topicals and more
Home grow Not allowed

Visitors with a medical card from another state can get a temporary Utah card.

Driving and work

Driving with THC in your system can lead to a DUI in Utah, and impaired driving is illegal for cardholders too. Employers can keep drug-free workplace policies.

Is anything changing in 2026?

No major changes to the purchase limits took effect in 2026. Utah's ballot initiative process exists, but lawmakers can and have rewritten voter-approved measures.

Federal law in 2026

Federal law still treats recreational cannabis as illegal. In April 2026, the federal government moved marijuana sold under a state medical license (and FDA-approved cannabis medicines) to Schedule III, but adult-use cannabis is still Schedule I. That means it's still banned on federal land and can't legally cross state lines, even between two legal states.

Separately, a federal ban on intoxicating hemp products takes effect in two steps: synthetic and converted cannabinoids like delta-8 lose their legal status on November 12, 2026, and naturally derived hemp THC (THCA flower, hemp delta-9 edibles and drinks) on December 11, 2026.
